How much does a patent cost on Average in the USA?

There are three categories of expenses for the typical patent application: (1) patent attorney fees; (2) patent filing fees; and (3) patent drawing fees.  Of the three, the most significant expense is the attorney fees. Below is information to give you a sense of what patent costs to expect from typical intellectual property patent law firms in the USA.

In February 2008, Alan Kasper of the American Intellectual Property Law Association (AIPLA), presented information to an oversight hearing regarding the United States Patent and Trademark Office (USPTO).  His presentation included information regarding the average patent costs in 2007.  The information came from the AIPLA 2007 Report of the Economic Survey compiled from a survey of patent attorneys and agents..

According to the testimony the following patent costs are representative of the attorney fees charged by a typical intellectual property boutique firm in 2007.

The average patent cost of preparing a utility patent application:

  • Preparation and filing cost of an original patent application of minimal complexity by a small patent firm (10 page specification, 10 claims) cost $8,548.00.
  • Relatively complex biotechnology/chemical patent cost $15,398.00
  • Relatively complex mechanical patent cost $11,482.00
  • Relatively complex electrical/computer patent cost $13,684

Once a patent application has been filed, there are often one or more rounds of amendments at the USPTO over the course of several years of prosecution.  Each round of patent amendments requires additional patent attorney fees.  According to the 2007 AIPLA report, the average attorney fees for each amendment were as follows.

The average patent cost for filing an amendment (e.g., responding to an office action during patent prosecution):

  • Minimal complexity patent cost is $2,244.00
  • Relatively complex biotechnology/chemical patent cost is $4,448.00
  • Relatively complex electrical/computer patent cost cost is $3,910.00
  • Relatively complex mechanical patent cost is $3,506.00

Post-allowance and patent issuance fees:

When a patent application is allowed at the USPTO, the applicant must pay an issue fee before the patent is granted.  The current utility patent issue fee is $1,510.00 for a large entity and $755.00 for a small entity.  Once issued, patent maintenance fees are due at 3.5, 7.5 and 11.5 years after issuance.  The current large entity/small entity patent maintenance fees are $980.00/$490.00 at 3.5 years, $2,480.00/$1,240.00 at 7.5 years and $4,110.00/$2,055.00 at 11.5 years.  These patent fees are mandated by and paid to the USPTO. 

The publication of the AIPLA Report of the Economic Survey 2009 demonstrates that these costs have risen or remained flat in the two years since the previous survey.

What Are Patents, Trademarks, Servicemarks, and Copyrights?

The difference between patents, copyrights, and trademarks can be confusing sometimes.  Although there may be some similarities among these kinds of intellectual property (IP) protection, they are different and serve very different purposes.

What Is a Patent?

A patent for an invention is the grant of a property right to the inventor, issued by the Patent and Trademark Office. The term of a new patent is 20 years from the date on which the application for the patent was filed in the United States or, in special cases, from the date an earlier related application was filed, subject to the payment of maintenance fees. US patent grants are effective only within the US, US territories, and US possessions.

The right conferred by the patent grant is, in the language of the statute and of the grant itself, "the right to exclude others from making, using, offering for sale, or selling" the invention in the United States or "importing" the invention into the United States. What is granted is not the right to make, use, offer for sale, sell or import, but the right to exclude others from making, using, offering for sale, selling or importing the invention.

What Is a Trademark or Servicemark?

A trademark is a word, name, symbol or device which is used in trade with goods to indicate the source of the goods and to distinguish them from the goods of others. A servicemark is the same as a trademark except that it identifies and distinguishes the source of a service rather than a product. The terms "trademark" and "mark" are commonly used to refer to both trademarks and servicemarks.

Trademark rights may be used to prevent others from using a confusingly similar mark, but not to prevent others from making the same goods or from selling the same goods or services under a clearly different mark. Trademarks which are used in interstate or foreign commerce may be registered with the Patent and Trademark Office.

What Is a Copyright?

Copyright is a form of protection provided to the authors of "original works of authorship" including literary, dramatic, musical, artistic, and certain other intellectual works, both published and unpublished. The 1976 Copyright Act generally gives the owner of copyright the exclusive right to reproduce the copyrighted work, to prepare derivative works, to distribute copies or phono records of the copyrighted work, to perform the copyrighted work publicly, or to display the copyrighted work publicly.

The copyright protects the form of expression rather than the subject matter of the writing. For example, a description of a machine could be copyrighted, but this would only prevent others from copying the description; it would not prevent others from writing a description of their own or from making and using the machine. Copyrights are registered by the Copyright Office of the Library of Congress.
